Decision of the Competition Commission dated 13/06/2017

You are informed that following the complaint of the Municipality of Pafos (File No.: 11.17.016.05), the Competition Protection Committee (CPC) issued the decision dated 13/06/2017.


The aforementioned Complaint concerned, the decision of the General Assembly of the SIEMEK, following which the SIEMEK invited and/or urged its members not to submit tenders for projects announced through the method of internal subcontracting, such as the project for the restoration and landscaping of the Paphos Municipal Market, the award of which was decided by the Municipal Council of the Municipality of Paphos through a public open tender.


According to the decision of the Competition Protection Committee, the decision of the SIEMEK, which was communicated to the members of the association through a Press Release dated 04/03/2016, as well as through a relevant circular of the Employers' Federation of the same date 18/05/2016, was deemed to violate Article 3(1)(b) of the Protection of Competition Laws of 2008 and 2014.


Accordingly, despite the fact that the aforesaid decision was effectively revoked from 17/06/2016 onwards, we reiterate and inform you that the said decision and/or the Circular is of no application. We further inform you that a relevant Circular of the Association will also be issued which will include a decision of the Association that its members are free to choose on their own criteria whether or not to bid and on which projects.
